OVERVIEW
The Privacy Act 1988 (Cth) (Privacy Act) provides extensive regulation about the collection, storage and use of information relating to individuals.
Sundrop Holdings Pty Ltd and its subsidiaries (the Group) recognises the importance of protecting personal information which it may be required to collect from individuals who become associated with its business. The purpose of this Privacy Policy is to ensure that any personal information that is provided to the Group is collected, held, used and disclosed according to the requirements of the Privacy Act and the Australian Privacy Principles.
The Privacy Act (and this policy) does not apply in respect of the collection, use or disclosure of information contained in employee records held by the Group where the collection, use or disclosure is directly related to a current or former employment relationship between the Group and an employee.
Kinds of personal information collected
The Group collects and holds personal information about customers, job applicants, staff members, contractors and other people who come into contact with the Group. The kinds of personal information that the Group may collect and hold include an individual’s name, gender, date of birth, physical address, phone number, e-mail address, geographic location, current and previous employment information, and any other information provided to the Group when an individual interacts with us or uses our website.
How personal information is collected
Where possible, the Group collects personal information directly from the relevant individuals. In some instances, the Group may collect personal information from third parties, including but not limited to third parties handling marketing or recruitment.
The Group acknowledges that, unless we are required by law to deal with an identified individual, there is no obligation for an individual to provide personal information or to identify themselves when providing personal information. However, if an individual chooses not to provide the Group with identifiable personal information, the Group may not be able to effectively provide the individual with the full range of its services.
How personal information is used
The Group may use collected personal information to allow i t to conduct its business, provide marketing materials, satisfy the internal needs of the organisation, assess employee and contractor suitability, and for other purposes that are reasonably necessary in connection with our ordinary functions and activities.
In the event that sensitive information is collected by the Group (including but not limited to criminal records, health information or details of membership of a professional or trade association or trade union), it will only be used for the purpose for which it was collected (and any directly related purpose) unless the individual provides express permission otherwise.
How personal information is disclosed
The Group may disclose personal information to any of its Group entities, contractors, consultants, advisers and related entities. The Group may need to disclose personal information to other organisations to comply with its legal obligations, such as auditors, legal advisers and the Australian Taxation Office (or any other relevant organisations). The Group may disclose personal information to any referees provided as part of an individual’s job application.
Disclosure to other external parties or entities will not occur without the individual’s consent except where disclosure is required by law.
The Group is unlikely to be required to disclose personal information to overseas recipients.
How personal information is stored and retained
Personal information collected by the Group is retained as part of a database, which is securely monitored and maintained by the Group. Other than as outlined in this policy, the information is not made available to any third parties, unless legally required, without the authority of the individual who provided the personal information.
The Group takes all reasonable steps to protect the security of the personal information that it holds. This includes appropriate measures to protect electronic materials and materials stored and generated in hard copy.
Where information held by the Group is no longer required to be held, and retention is not required by law, the Group will destroy such personal information by secure means.
Access to personal information
An individual may obtain access to personal information held by the Group by contacting us using the contact details set out below. Where copies of personal information held by the Group are requested, the Group will endeavour to provide the requested personal information as soon as reasonably practicable.
The Group reserves the right to charge a nominal fee if required for the retrieval of information requested.
An individual may request that the Group updates personal information about that individual held by the Group by using the contact details set out below.
Changes to this policy
The Group reserves the right to change this policy at any time. The updated policy will be available on our website.
Complaints and contact details
If an individual has any concerns or queries regarding the privacy or management of their personal information, the individual may make a complaint to HR Manager australia@sundropfarms.com who will endeavour to resolve the complaint as soon as reasonably practicable.
If an individual is not satisfied with the Group’s response to a complaint, a complaint may be lodged to the Office of Australian Information Commissioner via this website: https://www.oaic.gov.au/privacy/privacy-complaints.
